1. Agreement to Terms

These Terms & Conditions ("Terms") govern your access to and use of the TenGate website (10g8.com and related domains), the TenGate Portal, and any services, software, or support provided by TenGate ("TenGate", "we", "our", or "us").

By accessing our website, subscribing to a plan, or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

2. Our Services

TenGate provides "CTO as a Service" — a subscription that gives you access to a team for software architecture, design, development, DevOps, branding, marketing, and ongoing technical advice.

Work is delivered through your personalized task board. You may submit unlimited requests, which are handled one at a time in the order agreed with you.

3. Subscriptions & Billing

• Subscriptions are billed monthly in advance at the price shown at the time of purchase.
• A billing cycle is based on 22 working days. You may pause your subscription; unused days are preserved for future use.
• You may cancel at any time. Cancellation stops future renewals; fees already paid are non-refundable except where required by law.
• We may support milestone-based and cryptocurrency payments where offered. Applicable taxes may be added.

4. Requests, Revisions & Turnaround

Turnaround times vary with complexity; most requests are completed within 1–3 business days on average. We iterate on deliverables until you are satisfied, within the scope of your active subscription.

You are responsible for providing timely feedback, access, and any materials reasonably needed to complete a request.

5. Intellectual Property

Upon full payment, you own 100% of the source materials, code, and intellectual property we create specifically for you under your subscription.

We retain ownership of our pre-existing tools, libraries, know-how, and any generally reusable components, and grant you a license to use them as part of your deliverables.

6. Confidentiality

Both parties agree to keep each other’s confidential information private and to use it only to perform under these Terms. Your first task on the board will typically involve signing a confidentiality agreement.

7. Acceptable Use

You agree not to use our services to build, distribute, or support anything unlawful, infringing, harmful, or that violates the rights of others. We may decline or stop work that conflicts with these Terms or our policies.

8. Warranties & Disclaimers

Services are provided on a commercially reasonable, "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, TenGate will not be liable for any indirect, incidental, special, or consequential damages. Our total liability for any claim will not exceed the amount you paid to us in the three (3) months preceding the event giving rise to the claim.

10. Termination

You may stop using our services at any time. We may suspend or terminate access if these Terms are breached or if required to protect our services, team, or other clients. Sections that by their nature should survive termination will continue to apply.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last Updated" date below. Continued use of our services after changes take effect constitutes acceptance of the revised Terms.
